Notice Regarding Strengthened U.S. Immigration Policies and Entry Inspections

In light of recent actions by the U.S. government to strengthen immigration enforcement, Korean nationals currently residing in or planning to enter the United States are advised to take note of the following precautions to avoid potential disadvantages.
Important Notes for Residents in the U.S.
If you are staying in the U.S. for study, employment, or visitation, please check the validity of your visa in advance and renew it before it expires.
While residing in the U.S., always carry valid identification and have emergency contact information readily available.
Legal Violations May Lead to Serious Consequences
Even minor violations (e.g., DUI, verbal disputes) may result in enforcement actions and affect your legal status.
F-1 visa holders (international students) may face deportation or other serious consequences if caught engaging in unauthorized employment.
According to the Executive Order issued on January 29, 2025, foreign students participating in anti-Semitic demonstrations may be subject to investigation and deportation. Please be extremely cautious regarding such involvement.
Employers of immigrant-origin workers in the U.S. must complete and retain Form I-9 for each employee as required by law.
Right to Consular Assistance in Case of Arrest or Detention
If a Korean national is arrested or detained in the U.S., they have the right to request consular access. U.S. authorities are obligated to inform the Korean Consulate without delay.
If needed, please contact the nearest Korean Consulate for assistance.
(According to the Vienna Convention, the right to request consular access and be informed of your rights is mandatory.)
Important Notes Regarding ESTA Entry
ESTA (Electronic System for Travel Authorization) allows visa-free entry for up to 90 days. However, entry may be denied if the immigration officer determines your purpose of visit does not meet ESTA conditions.
In such cases, you must obtain an appropriate visa in advance. It is important to provide truthful and clear answers during the entry interview.
Immigration officers may check the following:
Purpose of visit, accommodation details, contact information, return schedule
Contents of mobile devices/social media, luggage inspection, etc.
